Violations and Administrative Fines

An administrative fine system was established to ensure compliance with the City of Henderson's conservation measures. Our intent is to educate citizens on conservation measures, not to penalize them for non-compliance.

  • Upon initial discovery of a violation of the conservation ordinance, the City will extend a courtesy notice in the form of a door hanger or flag placed on the property, or the property owner/manager will be notified by phone or mail.

  • If a second violation occurs within 18 months, a warning letter may be issued.

  • If the violation is not corrected within 10 days, an administrative fine may be assessed on the water bill. Fines will continue to double every 10 days until the violation is corrected. Failure to correct the violation could escalate to include the issuance of a misdemeanor citation or termination of service, or both.

  • Administrative fines are cumulative within an 18 month period.

Administrative Fines

Customers in violation of the conservation ordinance will be assessed an administrative fine according to the following table. The majority of Henderson residential customers are served by a water meter that is 1 inch or less.

Appeals Process

All appeals for reconsideration must be in writing and must be filed with the City of Henderson Director of Utility Services or his designee within 10 days of receiving a notice of violation. Written appeals should be sent to the following address.

The decision of the Director or his designee shall be rendered within 10 days of the date of the hearing of the appeal. Such decision shall be deemed to be the final administrative action on the appeal.
