What is eDiscovery?

The City Attorney’s Office (CAO) stores documents related to a criminal case in an electronic format. This is also known as electronically stored information (ESI). Examples of the types of ESI stored in the system include case documents such as reports, witness statements, photos, audio and video files, etc.

When possible, criminal discovery will be submitted to opposing council electronically. This “discovery packet” will generally contain all discoverable information such as police reports, witness statements, photos, etc. Further, audio recordings will also be delivered electronically when size permits. Due to size limitations, video files such as Mobile Audio/Video (MAV) or Surveillance Video are an exception, as discussed below.

Bodycam and Carcam video will be provided electronically using a secure link from AvailWeb, when available.

How will I receive eDiscovery?

The discovery packets and discovery invoice will be uploaded to a secure download site, hosted by our case management system vendor. The site is secure and cannot be accessed by anyone other than the intended recipient. To access the discovery information, an email will be sent to the address on file for the defense attorney. The email will contain secure links to the discoverable information and the discovery invoice. Clicking on the links will allow the user to download the discovery information to their workstations.

How long do I have to download my eDiscovery packet?

Recipients will have sixty (60) days to download eDiscovery documents and files (including the invoice). If files are not downloaded within this time frame, a new request for discovery will need to be initiated.

What file format will I receive?

Most files, except MAV and other video recordings, will be delivered electronically Please click Download and Unzip a Zipped Media Folder for instructions on how to unzip a file folder.

How will I receive MAV and other video evidence?

Bodycam and Carcam video will be provided electronically using a secure link from AvailWeb, when available. Due to size limitations, all other video files will not be delivered via the secure site and will be sent on a physical disc via US Mail. However, the invoice for video evidence will be delivered through the normal eDiscovery process described above.
